Joint Notice of Privacy Practices

This notice describes the privacy practices of the entities participating in the LivBody HoldCo LLC Affiliated Covered Entity, including LivBody HoldCo LLC Healthcare Partners PC, Rezilient OLH, PA, and LivBody HoldCo LLC Healthcare Partners California, PC. For purposes of complying with HIPAA, the above-designated entities, which are under common ownership and control, have designated themselves an affiliated covered entity.

You have the right to:

  • Correct your paper or electronic medical record

  • Request confidential communication

  • Ask us to limit the information we share

  • Get a list of those with whom we’ve shared your information

More About Your Rights

Get an electronic or paper copy of your medical record
You can ask to see or get an electronic or paper copy of your medical record and other health information we have about you. Ask us how. We’ll provide it within 30 days of your request. We may charge a reasonable, cost-based fee.

Ask us to correct your medical record
You can ask us to correct health information you believe is incorrect or incomplete. We may say “no,” but we’ll tell you why in writing within 60 days.

Request confidential communications
You can ask us to contact you in a specific way or send mail to a different address. We will say “yes” to all reasonable requests.

Ask us to limit what we use or share
You can ask us not to use or share certain health information for treatment, payment, or operations. We may say “no” if it affects your care.
If you pay out-of-pocket in full, you can ask us not to share that info with your insurer. We will say “yes” unless a law requires us to share it.

Get a list of those with whom we’ve shared information
You can ask for an accounting of our disclosures of your health information for up to 6 years, excluding some uses such as treatment and operations. We’ll provide one free per year; a fee may apply for more.

Get a copy of this privacy notice
You can ask for a paper copy at any time, even if you agreed to receive it electronically.

Choose someone to act for you
If you have given medical power of attorney or have a legal guardian, that person can make decisions on your behalf. We will verify their authority.

File a complaint if you feel your rights are violated
You can complain to us using the contact information below.

Your Choices

In these situations, you have both the right and choice to tell us to:

  • Share info with family or friends involved in your care

  • Share info in a disaster relief situation

  • Include your info in a hospital directory

If you're unable to tell us your preferences, we may share if we believe it's in your best interest or needed to prevent serious health threats.

We will never share your information for these purposes without written permission:

  • Marketing purposes

  • Sale of your information

  • Most sharing of psychotherapy notes

Fundraising: We may contact you, but you can opt out.


How We Typically Use or Share Health Information

Treat you – Share info with healthcare professionals involved in your care.
Run our organization – Improve services, contact you, send appointment reminders.
Bill for your services – Share info with health plans for reimbursement.


Other Permitted Uses and Disclosures

For public health and safety:

  • Prevent disease

  • Report adverse medication reactions

  • Report abuse, neglect, or domestic violence

  • Prevent/reduce serious threats to health or safety

Do research – We may use/share for approved health research.

Comply with the law – Share info as required by federal/state law.

Respond to organ/tissue donation requests – Work with organizations as needed.

Work with a coroner, ME, or funeral director – Upon death, to aid investigations or funeral arrangements.

For government functions – Workers’ compensation, law enforcement, military, and national security.

In lawsuits/legal actions – Share info under a court order, subpoena, or legal process.


Our Responsibilities

  • We are required by law to maintain the privacy and security of your protected health information (PHI).

  • We will notify you promptly if a breach occurs that may have compromised your info.

  • We must follow this notice and provide it to you.

  • We will not use/share your info in ways not described here unless you authorize us in writing. You can revoke your permission at any time.

Changes to This Notice

We may change this notice, and those changes will apply to all your information. We’ll make the new notice available in our office and on our website at www.livbody.com.


SMS/MMS MOBILE MESSAGING MARKETING PROGRAM

We respect your privacy. We will only use information you provide through the Program to transmit your mobile messages and respond to you, if necessary. This includes, but is not limited to, sharing information with platform providers, phone companies, and other vendors who assist us in the delivery of mobile messages.  WE DO NOT SELL, RENT, LOAN, TRADE, LEASE, OR OTHERWISE TRANSFER FOR PROFIT ANY PHONE NUMBERS OR CUSTOMER INFORMATION COLLECTED THROUGH THE PROGRAM TO ANY THIRD PARTY. Nonetheless, We reserve the right at all times to disclose any information as necessary to satisfy any law, regulation or governmental request, to avoid liability, or to protect Our rights or property. When you complete forms online or otherwise provide Us information in connection with the Program, you agree to provide accurate, complete, and true information. You agree not to use a false or misleading name or a name that you are not authorized to use. If, in Our sole discretion, We believe that any such information is untrue, inaccurate, or incomplete, or you have opted into the Program for an ulterior purpose, We may refuse you access to the Program and pursue any appropriate legal remedies.

California Civil Code Section 1798.83 permits Users of the Program that are California residents to request certain information regarding our disclosure of the information you provide through the Program to third parties for their direct marketing purposes.  To make such a request, please contact us at the following address:
